Death Penalty repeal bills – SB 279 and HB 316 – are part of the O'Malley Administrations 2009 legislative package! 

In his State of the State address, the Governor called on the General Assembly to “give this important moral question of repeal of the death penalty a fair up-or-down vote in both houses of this legislature.” And he urged them to vote to abolish this “outdated, expensive, and utterly ineffective death penalty in Maryland.”

The Governor's sponsorship dramatically escalates the momentum created when the Maryland Commission on Capital Punishment recommended repeal of the death penalty in December 2008. The Commission made several factual findings, supported by the vast majority of its members, that underscore its recommendation for repeal.

Momentum is on the side of repeal. Senate President Miller told the Frederick News Post, “We're going to have a vote in the Senate . . . people will have options to bring the bill to the floor, I guarantee it."  Repeal bills have stalled in Senate's Judicial Proceedings Committee the previous two year. A death penalty supporter who cosponsored the bill that reinstated the punishment in Maryland in 1978, President Miller predicted a close Senate in favor of repeal, while acknowledging in the Baltimore Sun that the death penalty "is not working in the state of Maryland, because of judges, because of lawyers, because of cost."
